The victim of a pit bull attack receives a $500 fine.

A 49-year-old Pennsylvania woman was fined $500 following a vicious pit bull attack in which her pet poodle was killed and she was injured.

According to court reports, Bernadette Frable-Kirk was feeding several pit bulls in her Lehigh Valley home on Sept. 5th. The dogs, who belonged to her sister-in-law Tammy Frable, began fighting over the food and became aggressive. They then attacked her pet poodle, Ginger, mauling the smaller dog to death. The victim attempted to separate the dogs and in the process, received serious bite injuries to her legs and face.

Following the attack, the dog's owner was charged with six counts of of inflicting severe harm to a human being without provocation on public or private property. The victim, Ms. Frable-Kirk spent several days in the hospital receiving treatment for her injuries. Upon her release, she was charged with harboring a dangerous dog. The victim then received a $500 fine after a district court judge found her guilty of the charges.

Tammy Frable, 48, plead guilty to four of the six counts against her in exchange for having two of the dogs involved euthanized. She also faces a $500 fine for her role in the attack.

This case represents a unique situation in that the dog attack victim was held partially liable for the injuries she sustained. Had the pit bull attack occurred at the dog owner's home or another location, she may not have been held responsible. In fact, if she was injured in a dog attack due to the owner's negligence, she may have had grounds for a personal injury claim. The dog's owner may have been required to provide the victim with compensation for her medical bills, time away from work and pain and suffering.
