Sue The Landlord For The Bites of a Tenant's Dog
When Can A Dog Bite Victim Or The Victim's Parents Sue?
A California landlord can sometimes be held responsible in a court of law when a dog owned by a tenant bites another person. We have recovered in instances where the landlord was taking care of the tenant’s dog when the dog attacked our client. We have also obtained recoveries where the landlord or property owner did not repair a gate or fence, which allowed the dog to get out and attack our clients. In these cases, the landlord’s liability is based on negligence- which is the lack of due care. This is not strict liability which is the dog bite statute. Strict liability does not apply to the landlord, because he is not the dog’s owner.
We can also make a separate recovery for you for the costs of your suffering additional through rabies treatment if the owner’s dog did not have up to date rabies vaccinations. California Health and Safety Code Section 121690 requires every dog owner after the dog reaches the age of four months to at least once a year obtain a vaccination of the anti-rabies vaccine. We will then make an additional claim against the owner for the law’s violation for the additional expenses of anti-rabies treatment.
We are experts in dealing with and obtaining recoveries under the California dog bite statute, California Civil Code Section 3342, the California strict liability dog bite law reads as follows:
“3342(a): The owner of any dog is liable for the damages suffered by any individual who was bitten by the dog while in a public location or lawfully in a private location, which includes the property of the owner of the dog, regardless of the former viciousness of the dog or the owner’s knowledge of such viciousness. The individual is lawfully upon the private property of such owner within the meaning of this section when he is on such property in the performance of any duty imposed upon him by the laws of this state or by the laws or postal regulations of the United States or when he is on such property upon the invitation express or implied of the owner…”
